Often these initiatives involve adjustments to the companies\u2019 hiring practices. For example, businesses may enact strategies to ensure they interview a more diverse group of candidates with the hope that a diverse applicant pool will result in diverse hiring. <\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\">While these practices are often well-intentioned, they are often undermined by lack of enforcement and hiring managers sidestepping the intention of the policies. Two shocking examples from the past year highlight the problem of this approach to DEIB and shed light on steps companies need to take to ensure their initiatives are impactful.<\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\">&nbsp;<\/p>\n<h2 style=\"font-size: 36px; line-height: 1.5; text-align: left;\" style=\"font-size: 36px; line-height: 1.5; text-align: left;\" id=\"sham-interviews\"><span style=\"color: #000000;\">\u201cSham\u201d Interviews<\/span><\/h2>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\"> In June 2020, Charles W. Scharf, who later became the chief executive officer at Wells Fargo, pledged to consider a broader range of candidates for future roles. In response, Wells Fargo enacted a formal policy of interviewing a diverse group of candidates for jobs that paid $100,000 or more per year.<\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\"> In an <a href=\"https:\/\/www.nytimes.com\/2022\/05\/19\/business\/wells-fargo-fake-interviews.html?campaign_id=4&amp;emc=edit_dk_20220519&amp;instance_id=61803&amp;nl=dealbook&amp;regi_id=66937636&amp;segment_id=92737&amp;te=1&amp;user_id=49a5ea144a49270344b3345d2df7690f\" rel=\"noopener\" target=\"_blank\">interview<\/a> with the New York Times, Joe Bruno, a former executive in the wealth management division at Wells Fargo, accused the company of conducting fake interviews with \u201cdiverse\u201d candidates for jobs that had already been given to other applicants. <\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\">According to Bruno, he and seven other former employees reported that the interviews were more about recording the company\u2019s efforts on paper than hiring a more diverse group of candidates. <\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\">The National Football League (NFL) enacted a similar strategy with equally ineffective and harmful results. After researchers determined that black coaches were not given the same job opportunities, the NFL adopted what has become known as the <a href=\"https:\/\/theathletic.com\/3106413\/2022\/02\/01\/holder-brian-flores-lawsuit-a-reminder-the-rooney-rule-cant-change-hearts-and-minds\/\" rel=\"noopener\" target=\"_blank\">Rooney Rule<\/a>, which required the league to interview at least one non-white candidate for senior positions. <\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\">Though good in theory, the Rooney Rule proved problematic in practice. Like Wells Fargo, the NFL was accused of conducting fake interviews. <\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\">Brian Flores, former coach of the Miami Dolphins, stated that he received text messages from New England Patriots Coach Bill Belichick, congratulating him for being hired for a head coaching position he had not yet interviewed for. After asking if Belichick intended that message to go to Brian Daboll, a white candidate who had already been interviewed, Belichick said, \u201cI think they are naming Daboll. I\u2019m sorry about that. BB.\u201d<\/span><span style=\"color: #000000;\"><\/span><\/p>\n<p style=\"font-size: 18px; line-height: 1.5; text-align: center;\"><span style=\"color: #000000;\"><img decoding=\"async\" src=\"https:\/\/www.wellable.co\/blog\/wp-content\/uploads\/2022\/08\/Group%2036.png\" alt=\"Group 36\" width=\"602\" loading=\"lazy\" style=\"width: 602px; margin-left: auto; margin-right: auto; display: block;\"><\/span><span style=\"color: #595959; font-size: 16px;\"><em>Images taken from lawsuit filed by the former Miami Dolphins Coach Brian Flores against the NFL<\/em><\/span><span style=\"color: #595959;\"><\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\">Flores subsequently filed a<a href=\"https:\/\/www.nytimes.com\/interactive\/2022\/02\/02\/us\/brian-flores-nfl-lawsuit.html\" rel=\"noopener\" target=\"_blank\"> lawsuit against the NFL<\/a>. The case is still pending.<\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\">&nbsp;<\/p>\n<h2 style=\"font-size: 18px; line-height: 1.5; text-align: left;\" style=\"font-size: 18px; line-height: 1.5; text-align: left;\" id=\"takeaway\"><span style=\"color: #000000; font-size: 36px;\">Takeaway <\/span><\/h2>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\">These cases make it undeniably clear that having a policy that sounds good on paper isn\u2019t enough. Even a practice as seemingly harmless as interviewing a more diverse group of candidates can go wrong if not properly supported. As Linda Friedman , lawyer for the Black financial advisers involved in a 2017 Wells Fargo settlement, <a href=\"https:\/\/www.nytimes.com\/2022\/05\/19\/business\/wells-fargo-fake-interviews.html#:~:text=%E2%80%9CWell%2Dintentioned%20people%20created%20these%20initiatives%2C%20but%20when%20they%20hit%20the%20ground%20the%20energy%20was%20devoted%20not%20to%20implementing%20them%20but%20finding%20a%20way%20to%20get%20around%20them%2C%E2%80%9D%20said%20Linda%20Friedman%2C%20the%20lawyer%20for%20the%20Black%20financial%20advisers%20involved%20in%20the%202017%20Wells%20Fargo%20settlement.\" rel=\"noopener\" target=\"_blank\">told<\/a> the New York Times: <\/span><\/p>\n<blockquote>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #ffffff; font-size: 24px;\">Well-intentioned people created these initiatives, but when they hit the ground, the energy was devoted not to implementing them but finding a way to get around them.<\/span><\/p>\n<\/blockquote>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\">This tendency to find \u201ca way to get around\u201d the policies suggests that many members of these organizations are not sincerely interested in advancing DEIB, or at least that they feel there are other more pressing concerns. The problem is that a genuine concern for DEIB is essential for enacting successful policies. If anyone who is supposed to carry out something like the Rooney Rule doesn\u2019t understand why it\u2019s important, it is likely to be misapplied. <\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\">Training and education are a great way to help employees eliminate unconscious bias and understand the importance of providing more opportunities to members of underrepresented groups. While managers might not immediately appreciate what makes them crucial, they may come around after being given some historical context and data points that support the need for the kinds of policies put in place by Wells Fargo and the NFL.<\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\"> Companies may also want to focus on developing better ways of enforcing the spirit of their policies. They should create ways of monitoring how the initiatives are being deployed and utilize incentives to discourage managers from implementing them in a superficial manner. <\/span><\/p>\n<p style=\"font-size: 18px; text-align: justify; line-height: 1.5;\"><span style=\"color: #000000;\">Another option is to write more detailed policies that rule out counterproductive behaviors from the start. The initiatives that the NFL and Wells Fargo developed had loopholes that could be exploited. Better written strategies could avoid that without the need for additional policy enforcement. For example, organizations should clarify the purpose of their DEIB policies and specify that any efforts to implement the policies undertaken without the sincere intention of serving that purpose are
